Terms and Conditions

These Terms and Conditions (the "Terms") govern access to and use of Joy of Culture, including our website, mobile applications, services, content, booking tools, communications, and related features (the "Platform").

By accessing or using the Platform, creating an account, making a booking, submitting content, or otherwise using our services, Users agree to be bound by these Terms and by any policies referenced in them.

1. Who We Are and How to Contact Us

1.1 The Platform is operated by Joy of Culture.

2. Definitions

2.1 "Platform" means Joy of Culture, including its website, mobile applications, services, content, booking tools, communications, and related features.

2.2 "User" means any person who accesses or uses the Platform.

2.3 "Customer" means a User who browses, requests, reserves, or books an Experience through the Platform.

2.4 "Host" means an independent third party, referred to in Greek as a Provider of Experiences, who offers Experiences through the Platform.

2.5 "Experience" means an activity, service, event, session, tour, workshop, tasting, class, cultural activity, private session, or other experience offered by a Host and made available through the Platform.

2.6 "Booking" means a confirmed reservation for an Experience made through the Platform.

2.7 "Policies" means any additional policies, rules, standards, or guidelines made available by Joy of Culture, including the Privacy Policy, Cookie Policy, Cancellation and Refund Policy, and applicable Host Terms.

3. Acceptance of Terms

3.1 By accessing or using the Platform, Users confirm that they have read, understood, and agree to these Terms.

3.2 If a User does not agree to these Terms, the User must not access or use the Platform.

3.3 Additional terms or policies may apply to specific features, bookings, Experiences, promotions, or Host activities. If there is a conflict between these Terms and a specific policy, the specific policy will apply to the extent of the conflict for the relevant matter.

4. Eligibility and Accounts

4.1. Eligibility

4.1.1 The Platform is intended for use by individuals who are at least eighteen (18) years old and have the legal capacity to enter into a binding agreement.

4.1.2 Customers must be at least 18 years old to create an account and make bookings.

4.2. Account Registration

4.2.1 Users must provide accurate, current, and complete information when creating or maintaining an account.

4.2.2 Users are responsible for maintaining the confidentiality of their login credentials and for all activities carried out through their account.

4.2.3 Users must promptly update their account information if it changes.

4.3. Use on Behalf of Entities

4.3.1 If a User accesses or uses the Platform on behalf of a company, organisation, or other legal entity, the User represents that they have authority to bind that entity to these Terms.

4.4. Account Security

4.4.1 Users must notify Joy of Culture if they suspect unauthorised access to or use of their account.

5. Role of Joy of Culture and Hosts

5.1 Joy of Culture acts as an online marketplace that connects Customers with independent Hosts.

5.2 Joy of Culture does not own, create, sell, resell, provide, control, manage, or deliver Experiences, unless expressly stated otherwise.

5.3 Hosts are responsible for the Experiences they offer, including descriptions, availability, prices, suitability, safety, quality, delivery, licensing, permits, insurance where applicable, and compliance with applicable laws.

5.4 Hosts are independent third parties and are not employees, agents, representatives, partners, or joint venturers of Joy of Culture. Nothing in these Terms creates an employment, agency, partnership, joint venture, or similar relationship between Joy of Culture and any Host.

5.5 To the fullest extent permitted by law, Joy of Culture is not a party to any agreement between a Customer and a Host, except as expressly stated in these Terms or an applicable policy.

5.6 Hosts may be subject to additional host-specific terms, policies, standards, or requirements. If a User registers, applies, or acts as a Host, the User agrees to comply with the applicable Host Terms and any other host-related policies made available by Joy of Culture.

6. Experience Information and Availability

6.1 Experience information may include descriptions, location, date, time, duration, price, availability, language, age restrictions, participation requirements, accessibility information, what is included or excluded, and applicable cancellation rules.

6.2 Experience information is provided primarily by Hosts. Customers are responsible for reviewing all Experience details, requirements, restrictions, location information, cancellation terms, and other relevant information before making a booking.

6.3 Joy of Culture may take reasonable steps to review or display Experience information, but does not guarantee that all information provided by Hosts is complete, accurate, current, suitable, available, or error-free.

6.4 Until a booking is confirmed, availability is not guaranteed. Experiences may remain subject to Host approval, minimum participant requirements, scheduling, availability, payment processing, or other applicable conditions.

6.5 If there is an obvious error in the price, availability, description, date, time, location, or other material information of an Experience, Joy of Culture may correct the error and, where necessary, cancel, reject, or adjust the affected booking. Where this happens, we will notify the Customer and, where applicable, any amount paid or reserved will be refunded or released in accordance with the applicable payment process and Cancellation and Refund Policy.

7. Bookings, Payments and Fees

7.1. Booking Types

7.1.1. Instant Booking

7.1.1.1 For Instant Bookings, the Customer completes the checkout process and payment is processed immediately.

7.1.1.2 The booking is confirmed once payment is successfully completed and the Customer receives booking confirmation.

7.1.2. Minimum Participants Booking

7.1.2.1 For Experiences that require a minimum number of participants, the Customer's payment method may be pre-authorised or the booking amount may be reserved when the Customer submits the booking.

7.1.2.2 The booking will only be confirmed and payment will only be captured once the required minimum number of participants has been reached.

7.1.2.3 Unless otherwise stated in the Experience listing or applicable policy, the minimum number of participants must be reached at least twenty-four (24) hours before the scheduled start time of the Experience.

7.1.2.4 If the minimum number of participants is not reached within that timeframe, the booking may be cancelled and the reserved amount will be released, subject to the processing times of the Customer's bank, card issuer, or payment provider.

7.1.3. Request to Book

7.1.3.1 For Request to Book Experiences, the Customer submits a booking request for approval by the Host.

7.1.3.2 The Customer's payment method may be pre-authorised or the booking amount may be reserved when the request is submitted.

7.1.3.3 The booking is not confirmed until the Host approves the request, payment is successfully captured, and the Customer receives booking confirmation.

7.1.3.4 Unless otherwise stated in the Experience listing or applicable policy, the Host has twenty-four (24) hours to approve or decline the booking request.

7.1.3.5 If the Host declines the request, does not respond within that timeframe, or the request expires, the booking will not be confirmed and the reserved amount will be released, subject to the processing times of the Customer's bank, card issuer, or payment provider.

7.1.4. Custom Session Requests

7.1.4.1 Where enabled by a Host, a Customer may request a specific date and time for an Experience, including a private group or private session where available.

7.1.4.2 The Host may approve or decline the request at its discretion and may confirm the applicable price for the requested session.

7.1.4.3 No payment is processed or reserved before the Host approves the request.

7.1.4.4 A custom session request is not a confirmed booking unless and until the Host approves the request, the Customer completes payment within the applicable timeframe, and the Customer receives booking confirmation.

7.1.4.5 Unless otherwise stated, once the Host approves a custom session request, the requested session is held exclusively for that Customer for twenty-four (24) hours.

7.1.4.6 If the Customer does not complete payment within that period, the requested session may be released and made available again, and no booking will be confirmed.

7.1.4.7 Custom session requests, private groups, and private sessions are subject to the same Cancellation and Refund Policy as other bookings, unless otherwise required by applicable law.

7.1.5. Pre-authorisations and Reserved Amounts

7.1.5.1 A pre-authorisation or reserved amount may appear as a pending transaction on the Customer's bank statement or payment account, but it is not a final completed payment unless the booking is confirmed and payment is captured.

7.1.5.2 If a booking is not confirmed, the reserved amount will be released, subject to the processing times of the Customer's bank, card issuer, or payment provider. Joy of Culture does not control the time required by banks, card issuers, or payment providers to release reserved amounts.

7.2. Booking Confirmation

7.2.1 In all booking types, the Customer will receive a booking confirmation by email once the booking is confirmed.

7.2.2 A booking is not considered confirmed until the applicable confirmation conditions have been met and the Customer has received confirmation through the Platform or by email.

7.3. Prices, Service Fees and Taxes

7.3.1 The price of each Experience is set by the Host.

7.3.2 Joy of Culture may charge Customers a service fee in addition to the price set by the Host.

7.3.3 Any applicable service fee, taxes, charges, or total amount payable will be displayed before the Customer completes the booking.

7.3.4 Service fees may be non-refundable unless otherwise stated in the applicable Cancellation and Refund Policy or required by law.

7.3.5 Customers are responsible for reviewing the total amount before confirming payment.

7.4. Payment Processing

7.4.1 Payments are processed through third-party payment providers. Customers authorise Joy of Culture and/or its payment providers to charge, reserve, capture, release, or refund amounts in accordance with the applicable booking flow, these Terms, and the Cancellation and Refund Policy.

7.4.2 Joy of Culture does not store payment card details. Payment card details are processed by third-party payment providers.

7.4.3 Failed payments, expired authorisations, suspected fraud, chargeback risk, or payment provider issues may result in a booking not being confirmed, being cancelled, or being delayed.

7.4.4 All payments are processed in Euros (EUR), unless otherwise stated. Customers are responsible for any currency conversion fees, bank fees, card issuer fees, or similar charges.

7.5. Booking Rejection or Cancellation by Joy of Culture

7.5.1 Joy of Culture may reject, cancel, suspend, or refuse to process a booking where we reasonably believe that there is suspected fraud, misuse, abuse, a payment issue, a chargeback risk, an error in pricing or availability, a violation of these Terms or our policies, a safety concern, or another legitimate reason.

8. Cancellations, Refunds and EU Consumer Rights

8.1 Bookings, cancellations, refunds, rescheduling, no-shows, and related customer rights are subject to the applicable Cancellation and Refund Policy made available by Joy of Culture.

8.2 Nothing in these Terms or the Cancellation and Refund Policy affects any mandatory statutory consumer rights that cannot be excluded under applicable law.

8.3 Where applicable, Customers acknowledge that the statutory right of withdrawal under EU consumer law may not apply to leisure services where the booking provides for a specific date or period of performance.

8.4 Cancellations, refunds, and rescheduling remain subject to the applicable Cancellation and Refund Policy and any mandatory consumer rights under applicable law.

9. Customer Responsibilities

9.1 Customers are responsible for reviewing Experience details, requirements, restrictions, location information, timing, and cancellation terms before making a booking.

9.2 Customers must arrive on time, follow reasonable safety instructions provided by the Host, comply with participation requirements, and behave respectfully towards Hosts, other participants, venues, staff, and third parties.

9.3 Customers are responsible for assessing whether an Experience is suitable for them and for any persons included in their booking.

9.4 Customers must inform the Host in advance of relevant requirements, needs, restrictions, allergies, intolerances, medical conditions, accessibility needs, or other circumstances where these are relevant to the Experience.

9.5 Customers must not participate in an Experience if they are under the influence of alcohol, drugs, or other substances, or if their conduct may create a safety risk or disrupt the Experience.

9.6 If a Customer makes a booking on behalf of other participants, the Customer is responsible for ensuring that those participants are informed of and comply with these Terms, the applicable Cancellation and Refund Policy, the Experience details, safety requirements, age restrictions, participation requirements, and any reasonable instructions provided by the Host.

10. Age Restrictions and Minors

10.1 The Platform is intended for use by individuals who are at least eighteen (18) years old.

10.2 Customers must be at least 18 years old to create an account and make bookings.

10.3 Some Experiences may allow minors to attend only where this is expressly stated in the Experience listing and where they are accompanied and supervised by a responsible adult.

10.4 Customers are responsible for ensuring that any minors included in their booking meet the applicable age, safety, suitability, and participation requirements.

11. Health, Safety and Assumption of Risk

11.1 Some Experiences may involve physical activity, travel, outdoor conditions, food or drink, tools, equipment, animals, transport, cultural sites, third-party venues, or other inherent risks.

11.2 Customers are responsible for assessing whether an Experience is suitable for them and for any persons included in their booking, taking into account age, health, fitness, abilities, allergies, dietary restrictions, medical conditions, and other relevant circumstances.

11.3 Customers must follow reasonable safety instructions provided by the Host.

11.4 Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.

11.5. Food, Drinks, Allergies and Dietary Requirements

11.5.1 Where an Experience involves food, drinks, tastings, cooking, or similar activities, Customers are responsible for reviewing the Experience information and informing the Host in advance of any allergies, intolerances, dietary restrictions, medical conditions, or other relevant requirements.

11.5.2 Joy of Culture does not prepare or provide food or drinks and is not responsible for the ingredients, preparation, handling, labelling, or suitability of food or drinks provided by Hosts or third parties, except where liability cannot be excluded under applicable law.

12. User Conduct and Prohibited Conduct

12.1 Users must use the Platform lawfully, honestly, respectfully, and in accordance with these Terms and applicable policies.

12.2 Users must not:

12.2.1 violate laws, regulations, or third-party rights;

12.2.2 provide false, inaccurate, incomplete, or misleading information;

12.2.3 commit fraud, impersonation, identity misuse, payment misuse, or fake reviews;

12.2.4 harass, threaten, abuse, discriminate against, or harm others;

12.2.5 send spam, unsolicited messages, or harmful content;

12.2.6 attempt to bypass payments, fees, safety protections, cancellation rules, or Platform policies;

12.2.7 scrape, crawl, harvest, copy, or extract data from the Platform without permission;

12.2.8 interfere with the security, availability, integrity, or proper functioning of the Platform;

12.2.9 upload or transmit unlawful, infringing, defamatory, obscene, harmful, or malicious content;

12.2.10 introduce malware, viruses, or harmful code;

12.2.11 use the Platform for illegal, unsafe, misleading, or abusive purposes.

13. No Circumvention and No Off-Platform Payments

13.1 Users, Customers, and Hosts must not use the Platform to arrange bookings, payments, communications, or transactions outside the Platform in order to avoid service fees, payment processing, safety protections, cancellation rules, or other Platform policies.

13.2 Joy of Culture may suspend or terminate accounts, cancel bookings, remove listings, or take other appropriate action where it reasonably believes that a User or Host has attempted to circumvent the Platform.

14. Reviews and User Content

14.1 Users are responsible for any content they submit, upload, publish, or transmit through the Platform, including reviews, ratings, photos, messages, profile information, and other materials.

14.2 Users must ensure that their content is lawful, accurate, not misleading, respectful, and does not infringe the rights of third parties.

14.3 Users must not submit fake, misleading, abusive, discriminatory, unlawful, infringing, confidential, or harmful content.

14.4 Reviews and ratings should reflect genuine experiences and must not be manipulated, incentivised improperly, or submitted in bad faith.

14.5 Joy of Culture may remove, restrict, edit, or disable access to User content where we reasonably believe that it violates these Terms, applicable law, the rights of others, or the integrity and safety of the Platform.

14.6 Users retain ownership of their content. By submitting content through the Platform, Users grant Joy of Culture a worldwide, non-exclusive, royalty-free, transferable, and sublicensable licence to use, host, store, reproduce, display, publish, translate, adapt, distribute, and promote such content for the purpose of operating, improving, marketing, and promoting the Platform and Experiences.

14.7 Users represent that they have the rights necessary to grant the licence described above.

15. Intellectual Property

15.1 The Platform, including its name, brand, logos, design, text, software, user interface, graphics, databases, structure, functionality, and content, is owned by or licensed to Joy of Culture and is protected by intellectual property and other laws.

15.2 Users are granted a limited, personal, non-exclusive, non-transferable, revocable licence to access and use the Platform solely in accordance with these Terms.

15.3 Users must not copy, reproduce, distribute, modify, reverse engineer, scrape, extract, sell, exploit, or make commercial use of the Platform or any Platform content without our prior written permission, except as permitted by law.

15.4 Users must not use the Joy of Culture name, brand, logos, or confusingly similar marks without prior written permission.

16. Promotions, Discounts, Vouchers and Credits

16.1 Joy of Culture may offer promotions, discounts, vouchers, credits, referral rewards, or similar benefits from time to time.

16.2 These may be subject to additional terms, eligibility requirements, expiry dates, usage limits, and restrictions.

16.3 Unless otherwise stated, promotional benefits have no cash value, are non-transferable, and may not be combined with other offers.

16.4 Joy of Culture may modify, suspend, revoke, or refuse promotional benefits where permitted by law, including where we reasonably believe there has been fraud, abuse, misuse, error, or violation of applicable terms.

17. Taxes

17.1 Customers are responsible for reviewing any applicable taxes, charges, or fees displayed before completing a booking.

17.2 Hosts are responsible for determining, collecting, reporting, and paying any taxes, VAT, duties, levies, or similar obligations arising from their Experiences, listings, earnings, or use of the Platform, as further described in the applicable Host Terms.

17.3 Joy of Culture may collect, report, or remit taxes where required by applicable law.

18. Third-Party Services and Links

18.1 The Platform may contain links to, or integrate with, third-party websites, applications, services, tools, or providers, including payment providers, maps and location services, app stores, social login providers, analytics providers, communication tools, and external websites.

18.2 Joy of Culture is not responsible for the content, availability, terms, privacy practices, security, or services of third parties.

18.3 Users should review the applicable third-party terms and policies before using those services.

19. Platform Availability and Changes

19.1 Joy of Culture may update, modify, suspend, discontinue, or restrict access to all or part of the Platform, including features, content, services, listings, or functionality, at any time where reasonably necessary.

19.2 We do not guarantee that the Platform will always be available, uninterrupted, secure, or error-free.

19.3 We may perform maintenance, updates, or technical changes from time to time.

20. Disputes Between Customers and Hosts

20.1 If a dispute arises between a Customer and a Host, the parties should first try to resolve the matter directly and in good faith.

20.2 Joy of Culture may, at its discretion, assist with communication, support, or review of relevant information.

20.3 Joy of Culture is not the provider of the Experience, does not act as an arbitrator, mediator, insurer, or legal representative, and is not responsible for resolving disputes between Customers and Hosts, except where required by applicable law or under our applicable policies.

21. Complaints and Customer Support

21.1 Users may contact Joy of Culture at info@joyofculture.com for questions, support requests, complaints, safety concerns, payment issues, booking issues, refund-related questions, or reports of violations of these Terms or our policies.

21.2 We will review and respond to requests as appropriate, but we do not guarantee a specific outcome unless required by applicable law or an applicable policy.

22. Account Suspension and Termination

22.1 Joy of Culture may suspend, restrict, or terminate access to the Platform, accounts, bookings, listings, or Platform features where we reasonably believe that a User, Customer, or Host has violated these Terms, applicable law, our policies, or the rights of others, or where necessary to protect the safety, security, integrity, or reputation of the Platform.

22.2 Reasons may include suspected fraud, abuse, harmful conduct, fake reviews, misleading information, off-platform circumvention, chargebacks, payment disputes, safety risks, or misuse of the Platform.

22.3 Users may stop using the Platform or request account closure at any time, subject to any outstanding bookings, payments, disputes, legal obligations, or applicable policies.

22.4 Termination or suspension does not affect rights or obligations that arose before termination, including payment obligations, cancellation or refund obligations, liability, intellectual property rights, dispute-related provisions, and provisions that by their nature should survive termination.

22.5 Personal data may be retained or deleted in accordance with the Privacy Policy and applicable data protection laws.

23. Disclaimers and Limitation of Liability

23.1 The Platform is provided on an "as is" and "as available" basis, to the fullest extent permitted by law.

23.2 Joy of Culture does not guarantee that the Platform or any Experience will meet a User's expectations, be uninterrupted, error-free, secure, or available at all times.

23.3 To the fullest extent permitted by law, Joy of Culture is not liable for indirect, incidental, special, consequential, punitive, or loss-of-profit damages, or for acts, omissions, content, services, or Experiences provided by Hosts or third parties.

23.4 Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, wilful misconduct, or any liability that cannot be excluded or limited under applicable law.

23.5 Nothing in these Terms affects mandatory consumer rights that cannot be excluded or limited under applicable law.

24. Indemnification

24.1 To the fullest extent permitted by law, Users agree to indemnify and hold harmless Joy of Culture from claims, losses, liabilities, damages, costs, and expenses arising from or related to:

24.1.1 the User's breach of these Terms or applicable policies;

24.1.2 the User's violation of laws or third-party rights;

24.1.3 User content submitted through the Platform;

24.1.4 misuse of the Platform;

24.1.5 fraud, abuse, off-platform circumvention, or harmful conduct.

24.2 This indemnity does not apply to claims arising from Joy of Culture's own negligence, wilful misconduct, or liability that cannot be excluded under applicable law.

25. Force Majeure

25.1 Joy of Culture shall not be liable for any delay, failure, interruption, or inability to perform any obligation under these Terms where this is caused by events beyond our reasonable control, including natural disasters, extreme weather, fire, flood, pandemic, epidemic, war, terrorism, civil unrest, labour disputes, government actions, power failures, internet or telecommunications failures, payment provider failures, hosting provider failures, or other third-party service failures.

26. Privacy

26.1 The collection and use of personal data through the Platform is described in our Privacy Policy and Cookie Policy.

26.2 By using the Platform, Users acknowledge that Joy of Culture will process personal data in accordance with those policies and applicable data protection laws.

27. Changes to These Terms

27.1 Joy of Culture may update these Terms from time to time.

27.2 Where changes are material, we may notify Users through the Platform, by email, or by other appropriate means where required by law.

27.3 Continued use of the Platform after the updated Terms become effective constitutes acceptance of the updated Terms.

28. Governing Law and Jurisdiction

28.1 These Terms are governed by the laws of the Republic of Cyprus.

28.2 Subject to any mandatory consumer protection rights or jurisdiction rules that may apply, the courts of the Republic of Cyprus shall have jurisdiction over disputes arising from or relating to these Terms or the Platform.

29. Language

29.1 These Terms may be made available in English and Greek.

29.2 In case of any inconsistency between the English and Greek versions of these Terms, the English version shall prevail.
